Mira-Bhayander, Thane, North Mumbai: The residents of Chandresh Terrace Co-Op Housing Society Mira Road (East) are suffering due to the redevelopment decision taken by the committee members of the society, without their consent.
The committee members (secretary, chairman and treasurer) already signed an agreement with the builder (Shree Krishna builders). The only builder named in the agreement was Akshay Mehta . The topic of redevelopment was once told to the society members but the agreement was signed & agreed upon without the consent of all the members (still many members have not agreed & signed the agreement till date ).
No legal procedure was followed before indulging in the agreement. As a procedure of redevelopment, firstly consent of the society members were not taken. Entire procedure all the meetings were conducted in the absence of any legal authority or registrar. No advertisement was published in any of the newspaper regarding redevelopment of the building so that the interested builders could fill in the tenders and the residents couldn’t get a chance to view or select the best builder.
In the year 2011, a structure audit of the building was conducted through the auditor of the Mira Bhayander Municipal Corporation (m/s Biltcon Pvt Ltd) without informing the members of the society the audit report stated that the building is in danger zone and need redevelopment however the society members oppose the report. The building is just 18 years old and is in good condition and just requires repair & maintenance. In addition to the audit it was conducted by the engineer who was black listed in 2012-13. The audit report was never shared with the society members. The committee also sent a letter requesting to demolish the building and the same was never shared with the members.
All the proceedings were carried out in secrecy. Members directly received the third and last notification on 21st june 2013 until then when all the members were unaware of the proceedings. The members were been always pressurized to agree with the deal & sign the agreement .
After receiving the notification the members of the committee conducted a meeting and the subject of the meeting was to accept the terms of agreement to collect the cheques for the deposit provided by the builder & vacate the houses ; after the meeting it was also revealed the builder Akshay Mehta and to the surprise of the members there were 4 partners involved in the agreement.
The members opposed to agree and sign the agreement due to the following reason:
The chairman, secretary & treasurer left their homes without intimating any one and no contact details were provided about their new residence.
The most surprising thing is that the building which has been demolished on 21st august 2013 with involvement of MBMC and police protection; for the same building tenders have been invited by MBMC and last date of closing of tenders is on 30th august 2013 starting from 21st august. This all things shows scam with the involvement of police, municipal corporation & local body.
Many of the residents are still paying EMIs on the housing loan which they had taken to buy a flat in the society.
People are going through hardships. Only one question people have is whom should we consult and who shall give relief against these fraudulent practices? What about the ones who have lost their houses? Who shall help them? Where will they live?

- The builder who has agreed to take up the redevelopment work has never indulged in the redevelopment project earlier.
- The builders office is also rented .

- No extra area is been offered, no corpus fund, no0 bank guarantee, no advance cheques for the rent for the duration of redevelopment etc.
