Criminal Offense?So homosexuality is a criminal offense – but every crime must have a victim? Who is the victim in the sexual act of two gay men? It could have been an offense (which is also far-fetched) .. but criminal?? What is criminal is SC’s judgment … on the same lines, how would heterosexuals react if a SC judge of homosexual orientation bans heterosexuality?
Judgement or Opinion?When the Supreme Court of India takes a stance against something so obvious in 21st century – how does a citizen believe that it is a fair judgment but not the individual opinion of a single individual (the SC judge in this scenario) … should the lives of millions be dictated by the opinion of one person? Isn’t that what happens under autocratic regimes?
Back into the Closet?What is the status of those homosexual men and women who came out of the closet assuming that India is ready to progress towards assuring the basic sexual-orientation choice to it’s citizens? Are they all criminals now? What about those NGOs who were working hard towards educating Indians towards opening their minds towards other lifestyles and start to respect people’s personal choices?
Gay Love?Does our judiciary believe that homosexual relationships are for sex alone? It has been proven in numerous scientific studies that homosexual couples are like every other couple – and their relationships too are based on companionship and love. Gay men and women are not some twisted perverts who’re engaging in ‘unnatural’ sex which from YOUR standards is ‘ungodly’ …
Privacy / Human Rights?This judgment violates the privacy of an individual. So, if two men who’re openly gay and live together – are by default criminals. While making this assumption, you assume they’re having ‘unnatural’ sex. But how did you find that out? Did you have cameras installed in their bedrooms? You cannot prove this said ‘unnatural’ sex in the court of law without proof. And you can’t get proof without violating their privacy. Then, how is Sec 377 enforceable without some serious privacy & human rights violations?
Discourage Consenting Adults?In a free and democratic society, you don’t need the crutches of a law to claim basic dignity in the society. It’s a given. It is supposed to be common sense. At the time when Indian legislature and judiciary should be working towards taking a strong stand against rape and sexual harassment – they’re going in the opposite direction by axing the freedom of consensual sex. Why do free individuals need court’s permission to engage in consensual sex? All this fuss about rape in India but marital rape still doesn’t figure anywhere – but SC is very proactive in peeping into the bedrooms of consenting adults …
Individual Liberties?If individual rights need to be protected – instead of suppressing something natural and already prevalent – shouldn’t laws be made to give exclusive protection in homosexual rapes, which happen a lot in India – but are never acknowledged by our law enforcement agencies? Laws are made to protect the liberties and freedom of the individual. Individuals aren’t made to alter their natural urges and lifestyles to follow the law.
